1. Definitions
- Company means Sandalwood Memorials.
- Customer means the person placing the order.
- Goods means memorials, headstones, plaques, inscriptions and related products.
- Services means design, engraving, installation, cleaning or renovation work.
2. Acceptance of Terms
By placing an order, the Customer confirms that they have read, understood and agreed to these Terms and Conditions. These Terms override any conflicting terms unless agreed in writing by the Company.
3. Orders and Specifications
All orders must be confirmed in writing and include full inscription details, measurements and requested design elements.
The Customer is responsible for ensuring all spellings, dates and wording are correct prior to approval. Once proofs are approved, responsibility for errors transfers to the Customer.
4. Bespoke Products
All Goods are made to order. Once production has begun, orders cannot be cancelled, refunded or returned except where required by law or agreed in writing by the Company.
5. Proof Approval
Production will not begin until written approval of proofs is received. Approval confirms acceptance of layout, wording, design and dimensions.
6. Prices and Payment
Quotes are valid for 30 days unless stated otherwise.
We do not offer instalment plans. Due to the specialist nature and lead times of our work, our standard terms are a 50% deposit plus any applicable cemetery or churchyard fee when you place your order, with the remaining balance payable just before the memorial is fitted.
The Company reserves the right to suspend work if payment becomes overdue.
7. Delivery and Installation
Estimated completion and installation dates are guidance only and not guaranteed. Delays may arise due to weather, supplier issues, cemetery permissions or other circumstances beyond our control.
The Company is not liable for delays caused by third parties, including cemeteries, councils or independent masons.
8. Cemetery and Churchyard Regulations
All installations are subject to the regulations of the relevant authority. The Customer is responsible for obtaining permissions unless agreed otherwise.
The Company is not responsible for refusals, restrictions or subsequent rule changes imposed by authorities.
9. Natural Materials
Memorials are crafted from natural stone. Variations in colour, grain, texture and markings are inherent characteristics and not defects.
10. Quality and Workmanship
The Company will supply Goods and Services with reasonable care and skill. Faults arising from Company workmanship will be rectified at our discretion if reported within 14 days of installation or delivery.
This excludes damage caused by third parties, vandalism, weathering, ground movement or lack of maintenance.
11. Returns and Refunds
Due to the bespoke and personalised nature of memorial products, orders cannot be cancelled or refunded once production has commenced. If Goods are found to be faulty due to Company error, or do not match the approved specification, the Company will, at its discretion, repair, replace or rectify the item.
Customers must notify the Company in writing within 14 days of delivery or installation if they believe there is an issue. This policy does not affect statutory rights under the Consumer Rights Act 2015.
12. Limitation of Liability
To the fullest extent permitted by law, the Company shall not be liable for indirect or consequential losses. Total liability shall not exceed the value of the order.
Nothing in these Terms limits liability for death or personal injury caused by negligence or for fraud.
13. Force Majeure
The Company is not liable for delay or failure caused by events beyond reasonable control, including severe weather, supplier shortages, transport disruption or government restrictions.

15. Privacy
Personal information will only be used to fulfil your order and communicate with you. We do not sell or share customer data except where necessary to complete services or comply with legal obligations.
16. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
